Aside from Halloween, are there ever any times when it is LEGAL to wear a mask in public?

I understand that it is illegal in many jurisdictions to wear a mask (either a costume or a ski mask) which completely conceals one’s identity. And I realize that you would not be allowed to wear one into a bank, courthouse, etc., for security reasons.

But when are there exceptions to this rule? When I was at Wachovia Center for a Philadelphia 76ers game, I saw a Philly fan dressed from head to toe in a SpiderMan costume and nobody seemed to be bothering him. (well they did boo another guy dressed in a Santa outfit, but I digress…)

Also it goes without saying that even in instances where the wearing of masks is permitted, “certain” types of masks or costumes would be culturally inappropriate (i.e. you would obviously not wear a mask of Osama bin-Laden in Manhattan, or a Ku Klux Klan mask etc.,)

My first response was to think that your premise was wrong. I didn’t think it could possibly be illegal in “many” jurisdictions because it would mean that people would have to get waivers constantly for things like sports mascots, halloween, masquerade balls, movie shoots, party clowns, rodeos, etc. or the laws would be routinely “unenforced” by the local authorities.

Then I looked up the statutes for Florida, where I live. Sure enough, there’s several that disallow the wearing of masks on a public way (lane, walk, alley, street, road, highway, or “other”), upon other public property, upon the property of another, or at any demonstration or meeting. Most of these laws date from the early fifties, which makes me think they were developed specifically to combat the Klan and other vigilante groups.

So, I learn something new every day.

But wait, the story does not end there! A new section was added in 1997 clarifying the previous statutes to say that the prohibitions only apply if the purpose of the mask or concealment was to cause problems by harassment or criminal activity. So! My original theory has found justification.

And for good measure there is a list of exemptions from 1983 for holiday costumes, theater and theater-like “productions” (masquerades, various regional fests, etc.), emergency responders like firemen and hazmat crew, and any trade that requires it.

So what you end up with is a mishmash: laws that seem to make it almost impossible to legally wear a mask at all dating from one period, amended by common-sense exemptions from a much later period, and finally nearly obviated completely by a clarifying statute fairly recently. It seems very inefficient to have handled things that way rather than just repeal the original law and re-draft it with specificity but that’s government for you.
